Collection of Information
Information You Provide to Us: We collect information that you provide directly to us. Your Choices

Usage and Diagnostics: You can turn Palm Ventures Group usage and diagnostic services on or off at any time by navigating to Settings on your Device. If you change your settings after we have initiated a data upload, your new settings will go into effect after that process has been completed. Note that even if you turn this feature off, your Device will still send certain Device information (such as Device serial number, network carrier information, country, and operating system version) needed for critical services such as system or security updates.
Promotional Communications: You may opt out of receiving promotional communications from Palm Ventures Group by following the instructions in those communications. If you opt out of receiving promotional communications, we may still send you non-promotional emails, such as those about your account or our ongoing business relations.
Mobile Push Notifications/Alerts: With your consent, we may send promotional and non-promotional push notifications or alerts to your Device. You can deactivate these messages at any time by changing the notification settings on your Device.
Residents of the European Economic Area: We will process your data where we have lawful bases to do so. Lawful bases can include consent (e.g., if you sign up for a promotion), to perform our responsibilities under our contract with you (e.g., to provide products and services to you, process payments), and for our legitimate interests, provided that the processing doesn’t outweigh your rights and freedoms. User Content

IN NO EVENT WILL THE PVG PARTIES’ AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SERVICES EXCEED ONE HUNDRED DOLLARS ($100). THE LIMITATIONS OF DAMAGES SET FORTH HEREIN ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN US AND YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
Indemnity
You agree to indemnify, defend (at our request), and hold the PVG Parties harmless from and against any and all claims, liabilities, damages, losses, and expenses, (including without limitation, actual, indirect, incidental, consequential, and special damages, such as damages for expenses or business interruption, property damage, attorneys’ fees, and loss of use, data, revenue, income, profits, or value of assets or securities) arising from or related to any third-party claims relating to: (i) your alleged or actual violation of these Terms, (ii) your use of the Services or Services Content, (iii) your User Content, (iv) your violation, misappropriation, or infringement of any right of another party, or (v) your violation of any applicable laws or regulations.
